Foreclosure Bidder Requirements WI SS 846.155(2)

  • Does not own an interest in Wisconsin property against which taxes have been levied that are more than 120 days delinquent
  • Is not directly or indirectly owned, managed, or controlled, in whole or in part, by a person that owns an interest in Wisconsin property against which taxes have been levied that are more than 120 days delinquent
  • Does not directly or indirectly own, manage, or control, in whole or in part, an entity that owns an interest in Wisconsin property against which taxes have been levied that are more than 120 days delinquent
  • Has no unsatisfied judgment against it related to a state or local building code violation with respect to Wisconsin property
  • Is not directly or indirectly owned, managed or controlled, in whole or in part, by a person against whom an unsatisfied judgment exists related to a state or local building code violation with respect to Wisconsin property
  • Does not directly or indirectly own, manage, or control, in whole or in part, an entity against whom an unsatisfied judgment exists related to a state or local building code violation with respect to Wisconsin property
  • Is not submitting a bid on behalf of or as part of an agreement with a person that does not meet these qualifications

Foreclosure Guidelines

  • All sales are conducted on Wednesdays (except holidays) at 10:00 am. Sales are held at the lower West lobby (front steps) of the Rock County Courthouse.
  • Sale postings are available for viewing at the Clerk of Courts office in the Courthouse and on the Sheriff's Office website. If the property to be sold lies outside of the City of Janesville, there will also be postings inside the local municipality.
  • The Sheriff’s Office does not know the Plaintiff’s bid (opening price) until just before the sale. This price will not be announced until the sale starts.
  • The Sheriff’s Office does not have access to properties to be sold, and will not grant access to properties to be sold.
  • Bidders must have at least 10% of the bid price in hand at time of sale. This must be in form of cash, cashiers check, or money order. The cashiers check or money order must be payable to the Rock County Clerk of Courts.
  • Information of property liens can be obtained from the Register of Deeds, the Rock County Treasurer, and local municipality treasurers.
  • Sales are not final until confirmed by the Court at a confirmation hearing.
  • Evictions of prior owners, tenants, or occupants are done through a Writ of Assistance. These are drafted by an attorney, signed and sealed by the Court, and are acted upon only by the Sheriff’s Office. The cost of the eviction lies on the purchaser or plaintiff, as determined by the court.
  • Purchasers might be responsible for outstanding real estate taxes, tenant rights, lien holder rights, any other defects, and real estate transfer fees.
  • For information on the property, or conditions of the sale, contact the attorney listed on the foreclosure posting.
  • Please have an ID ready at time of sale, including Social Security card.
  • Please talk softly unless bidding, so everyone can hear sales announcements.
